Low Emission Zone (LEZ) Account
registration terms and conditions
Customers should read the following terms and conditions
carefully when completing their application with Transport for London ("TfL") for a LEZ Account (as defined below).
Once registered, a Customer will be able to pay the Low
Emission Zone charges (as specified in the Scheme Order) (the “LEZ Charges”)
and Penalty Charges by using its LEZ Account (the “Service”). By
participating in the Service through registration and/or payment, the Customer
agrees that it will be bound by these terms and conditions.
These terms and conditions are subject to, and should be read
in conjunction with, the terms and conditions of use of TfL’s website which are
available on the TfL website.
1. Definitions
In these terms and conditions the
following terms have the following meanings:
“Account Number” means the
unique number assigned by TfL to each LEZ Account;
“Administrator” means a
person nominated by the Customer (as an employee or authorised agent of the
Customer) to be responsible for the day-to-day administration of the Customer’s
LEZ Account and who will have the relevant functions specified in clause 5.4 in
relation to the LEZ Account;
“Authorised User” means a
person nominated by the Customer (as employee or authorised agent of the
Customer) to have the relevant functions specified in clause 5.4 in relation to
the LEZ Account;
“Charging Day” means each
period of twenty-four hours from midnight to midnight;
“Customer” means the person
(including an organisation) for whom and on whose behalf the relevant LEZ
Account is opened, as stated in the application for that LEZ Account;
“Customer Number” means the
unique number assigned by TfL to each Administrator and each Authorised User
with access to a LEZ Account;
“LEZ Account” means an
account through which the Customer may manage its use of the Low Emission Zone
and pay the LEZ Charge;
“LEZ Charges” has the
meaning given above;
“Low Emission Zone” means
the geographical area within which Registered Keepers of certain vehicles are
liable to pay the LEZ Charge, as set out in the Scheme Order;
“Penalty Charges” means
penalty charges imposed in relation to vehicles which are non-compliant and are
detected within the Low Emission Zone on a Charging Day, and are liable to
incur a LEZ Charge, but in respect of which the LEZ Charges have not been paid
for that Charging Day;
“Registered Keeper” means:
(A) in relation to a vehicle registered in the United Kingdom, the person in
whose name the vehicle is registered under the Vehicle Excise and Registration
Act 1994; or
(B) in relation to any other vehicle, the person by whom the vehicle is
kept;
“Scheme Order” means the
Greater London Low Emission Zone Charging Order 2006 confirmed by the Mayor of
London on May 3, 2007; and
“Service” has the meaning
given above.
2. Registration process
2.1 In order to apply for a LEZ Account, the Customer may either log on to
the TfL website (www.tfl.gov.uk/lezlondon)
or call 0845 607 0009 if within the UK and +44 (0) 207 310 8998 from outside
the UK. Alternatively, TfL may at any time open a LEZ Account on a Customer’s
behalf upon receipt of a Customer’s fully and correctly completed vehicle compliance
application or 100% discount application by post.
2.2 The Customer will be required to provide the following information on
application for a LEZ Account:
(A) contact details of the Customer;
(B) details of the Administrator who will act as primary contact for the
Customer and will receive all correspondence from TfL on the Customer’s behalf;
(C) requested PIN for secure access to the account;
(D) requested answers to a series of security questions; and
(E) at the Customer’s option, details of a valid credit card or debit card
from which LEZ Charges may be debited. This will mean that the Customer will
be asked only to confirm the last four digits of the credit card or debit card
number when making a LEZ Charge or Penalty Charge payment online or through the
contact centre.
2.3 The LEZ Account will be activated when the Customer is notified of its
activation online, by post or over the telephone (as appropriate to the
Customer’s method of application). The LEZ account should not be assumed to be
active until notification is received either online, by post or over the
telephone. Daily charges should be made, via alternative payment channels, for
any journeys made into the LEZ in the meantime.
2.4 The Customer will be issued with an Account Number and a Customer Number
for the primary Administrator of the Customer upon activation of the LEZ
Account. Any further Administrators and/or Authorised Users subsequently added
to the LEZ Account from time to time shall be issued with a Customer Number at
the time of addition. The relevant Administrator or Authorised User will be
asked for his or her Customer Number and corresponding PIN in order to use the
Service.
2.5 The Customer may register any vehicle to a LEZ Account, but the status
of each vehicle (in order to determine whether the Customer is liable to pay
the LEZ Charge in respect of that vehicle) shall be determined by TfL only.
3. Registration of card details and payment of LEZ Charges and
Penalty Charges
3.1 By registering a credit or debit card to a LEZ Account or by using any
non-registered card to pay a LEZ Charge or Penalty Charge, the Customer
confirms that it (and any Administrator and/or Authorised User that it has
permitted to use the card) is authorised to use such card. All credit and debit
cards are subject to validation checks and authorisation by the card issuer. If
the card issuer refuses to authorise payment TfL will notify the Customer that
the card has been rejected but is not obliged to inform the Customer of the
reason for the refusal. TfL may at its discretion allow a payment to proceed
where it has not yet received authorisation from the card issuer (for example,
where TfL is unable to contact the card issuer at the time of the transaction)
but shall not be responsible for any later refusal by the card issuer to
authorise payment. Subject to clause 9, TfL shall not be responsible for a
Customer’s card issuer or bank charging the Customer as a result of TfL’s
processing of its credit or debit card payment in respect of LEZ Charges, or in
respect of any refusals or delays in authorisation by the card issuer or bank.
3.2 LEZ Charge and Penalty Charge payments made by a Customer via its LEZ
Account will be debited, at the time of the transaction, from the credit or
debit card registered to the LEZ Account or from such other credit or debit
card as the Customer may select at the time of the transaction.
3.3 Via a LEZ Account, the Customer may make:
(A) a LEZ Charge payment for any vehicle registered to the LEZ Account at
any time during the period of sixty-four (64) working days immediately
preceding the Charging Day concerned until midnight the next day after the
Charging Day concerned; or
(B) a Penalty Charge payment as specified in the relevant Penalty Charge
notice.
3.4 Where the Customer elects to receive a receipt of a LEZ Charge or
Penalty Charge payment, receipt of a valid payment will be confirmed by TfL by
email or post to the Customer’s registered email or postal address (as selected
by the Customer). If the Customer does not receive a valid confirmation receipt
email or postal receipt from TfL, or elects not to receive a receipt, payment
of the LEZ Charge or Penalty Charge should not be assumed. In these
circumstances, the Customer may check if payment has been made by telephoning
the contact centre or by checking the status of the payment in its LEZ Account
online and, if payment has not been confirmed, shall pay the LEZ Charge or
Penalty Charge through another payment channel.
3.5 TfL may reject a LEZ Charge or Penalty Charge payment for any reason.
3.6 LEZ Charge and Penalty Charge payments will be deemed to be made for and
on behalf of the Registered Keeper of the vehicle in respect of which such
payment has been made.
3.7 On or before the day on which a LEZ Charge payment made by the Customer
through its LEZ Account is to be applied against a vehicle, any Administrator
of the Customer, or the Authorised User of the Customer who made the relevant
LEZ Charge payment may choose, via the LEZ Account, to:
(A) cancel the LEZ Charge payment (for example, where the relevant Vehicle
will no longer be in the Low Emission Zone on that day) and receive a refund to
the credit card or debit card with which the LEZ Charge payment was made;
(B) transfer the LEZ Charge payment to a different vehicle registered to the
LEZ Account. Where the Customer wishes to transfer the LEZ Charge to a vehicle
which is not registered to the LEZ Account, it may only do so by contacting the
contact centre; or
(C) transfer the LEZ Charge payment to a different Charging Day.
4. Monthly Statement
Customers may opt into the monthly
statement service at any time. Monthly statements will only be issued if the
Customer has used the LEZ Account to pay LEZ Charges within the past calendar
month.
5. Customer’s responsibilities
5.1 The Customer confirms, represents and warrants that all information
provided by it to TfL, including but not limited to information provided in its
application for a LEZ Account and all subsequent information provided by it in
relation to the LEZ Account, is true, complete and accurate in all respects.
The Customer must at all times provide up to date registration details, and
must ensure that it informs TfL as soon as possible of any changes to
registered credit or debit card details, or the loss, theft or expiry of the
same.
5.2 The Customer is responsible for all electronic communications and
content sent by it to TfL, including for the security of all data submitted by
it to TfL until it is received by TfL. Subject to clause 9, TfL accepts no
liability for data submitted by the Customer which is lost in transit or
corrupted during transit.
5.3 The Customer is responsible for reading all email messages received from
TfL. TfL is not responsible for the Customer's failure to read email messages
sent by TfL and to take action accordingly.
5.4 The Customer may nominate one or more Administrators and one or more
additional Authorised Users to pay LEZ Charges and Penalty Charges on its
behalf using the LEZ Account. Each Administrator and Authorised User will have
his or her own Customer Number and PIN. The following functions in relation to
the LEZ Account may be performed on behalf of the Customer by an Administrator
or Authorised User as indicated below:

The Customer is responsible for
allocating any Administrators and Authorised Users at its discretion. TfL
shall be entitled to assume that any person accessing the LEZ Account using a
valid Customer Number and PIN is authorised by the Customer to do so and
subject to clause 9, TfL shall not be liable for any loss or damage suffered by
the Customer as the result of access to the LEZ Account by unauthorised
persons.
6. Website availability and TfL's rights
6.1 The Service is provided on an "as is" and "as
available" basis and TfL does not warrant or guarantee that the service
will be uninterrupted or error-free. TfL may restrict or suspend online access
to the LEZ Account from time to time to allow for maintenance, repairs or the
introduction of new facilities or features. At times when the online access to
the LEZ Account is restricted or suspended the Customer shall be responsible
for paying any relevant LEZ Charges or Penalty Charges via another payment
channel and subject to clause 9 TfL shall have no liability in respect of the
same.
6.2 The Service is provided without any other representations, warranties or
guarantees by TfL (including any warranties implied or incorporated into these
terms and conditions by English law, except where the exclusion of such
warranties is prohibited by English law) unless expressly stated otherwise.
6.3 TfL reserves the right to close, suspend or block a LEZ Account at any
time without notice to the Customer in order to maintain the security and
integrity of the Service. TfL also reserves the right to change or discontinue,
temporarily or permanently, the Service at any time without notice. If the
Service is discontinued the Customer must pay the LEZ Charge or Penalty Charge
via another payment channel. The Customer agrees that, subject to clause 9, TfL
will not be liable to it or any third party for any closure, suspension or
blocking of its or any other LEZ Account, any modification to the Service or if
the Service is discontinued.
7. Security
7.1 The Customer must take all necessary steps to ensure any information
provided during registration and subsequently to TfL, including credit and
debit card details, Account Numbers, Customer Numbers and PINs, is kept
confidential, is used properly and is not disclosed to unauthorised persons.
The Customer agrees to notify TfL immediately if any such information has or is
likely to become known to person(s) not authorised to use it or is being or is
likely to be used in an unauthorised manner. Subject to clause 9, TfL will not
be liable for any loss or damage incurred by a Customer as a result of any
breach of security or unauthorised disclosure by the Customer, including
without limitation due to the misuse of a LEZ Account as the result of the
disclosure of a PIN to unauthorised persons and due to the use of a credit or
debit card by an unauthorised person.
7.2 If the Customer enters incorrect log-in details three times on any day,
or if TfL has reason to believe that there has been or is likely to be a breach
of security of misuse of the Service, the Customer’s LEZ Account may be locked
by TfL. In this event the Customer will be required to contact TfL and satisfy
such security measures as TfL may require before use of the Service may be
resumed. The Customer remains responsible for ensuring that a valid LEZ Charge
payment has been made where relevant by using an alternative payment channel.
7.3 TfL reserves the right to amend and update its security procedures
without notification to the Customer.
8. Unacceptable use of the Service
The Customer agrees not to use the
Service:
8.1 for illegal purposes, fraudulently or in connection with a criminal
offence;
8.2 to send, use or reuse material that is illegal, offensive, abusive,
indecent, defamatory, obscene, menacing, in breach of copyright, trademark,
confidence, privacy or any other right, is otherwise injurious to third parties
or which consists of or contains software viruses, political campaigning,
commercial solicitation, chain letters, mass mailings or “spam”; nor
8.3 in any way that causes, or is likely to cause, the Service or access to
it to be interrupted, damaged or impaired in any way.
9. TfL’s liability
Nothing in these terms and
conditions limits or excludes TfL’s liability in respect of death or personal
injury caused by the negligence of TfL or any other liability which may not be
excluded or limited under English law.
10. Acceptance of and changes to the terms
10.1 These terms and conditions apply to the Customer’s registration and
usage of the Service. The Customer agrees to these terms and conditions by
clicking the "I Accept" button on the registration form for a LEZ
Account on the TfL website, by registering for a LEZ Account over the telephone
or by submitting a vehicle compliance application or 100% discount application
by post. If the Customer declines to accept these terms, it will not be
entitled to use the Service.
10.2 TfL may change these terms and conditions from time to time at its
discretion. TfL shall notify the Customer in advance of any changes which TfL
considers to be material changes to these terms and conditions, but all other
changes shall not be notified specifically to the Customer. Changes shall take
effect as soon as they are made by TfL. The Customer is advised to read these
terms and conditions on a regular basis. Continued use by the Customer of the
LEZ Account shall be deemed to constitute the Customer’s acceptance of such
changes whether or not they have been notified specifically to the Customer.
11. Electronic communications
The Customer consents to receiving
communications from TfL electronically and, subject to its statutory rights,
agrees that all agreements, notices, disclosures and other communications
provided to it by TfL electronically satisfy any legal requirement that such
communications be in writing.
12. Miscellaneous
12.1 Omission by TfL to exercise any right under these terms and conditions
will not constitute a waiver of such right unless expressly stated by TfL in
writing to be a waiver.
12.2 The LEZ Account and the Customer’s rights and obligations under these
terms and conditions shall be personal to the Customer and shall not be
transferable or assignable to any other person.
12.3 No person other than the Customer and TfL shall have any rights under
the Contracts (Rights of Third Parties) Act 1999 to enforce any of these terms
and conditions.
13. Governing law and jurisdiction
13.1 These terms and conditions shall be governed by and construed in accordance
with English law. TfL and the Customer submit to the exclusive jurisdiction of
the English courts.
